DISCLOSURE OF HIPAA REGULATIONS

Cross Cultural Care Center (CCCC) reviews the following with the participant and/or caregiver:

 

Regulations:

1. A written explanation of how health information can be used, kept and disclosed.

2. Provision of participant/caregiver access to medical records;
Access to see and get copies of their records; ability to request.

Amendments; access to a history of most disclosures

3. Documentation of participant/caregiver consent for routine disclosures before information is released for treatment, payment and health care operations purposes. Also, specific consent for non-routine uses and most non-health care purposes, such as releasing information to financial institutions, mailing lists.

4. Documentation of the right to request restrictions on the uses and disclosures of their information.

5. Documentation that consent is not coerced.

6. Documentation of the right to complain to the center, or to the Secretary of HHS about violations of the provisions of this rule.

7. Documentation that the center will use the participant’s health information for health purposes only, and will be limited to the minimum necessary for the purpose of disclosure.  This provision does not apply to the transfer of medical records for purposes of treatment.

 

INDIVIDUAL SERVICE PLANNING:

Intake Screening

Cross Cultural Care Center conducts an intake screening to determine whether the center can serve the individual.  If possible, the screening includes an interview with the participant and the participant’s caregiver.  The center notifies the individual of the outcome no more than five working days after the screening process has begun.

 

INITIAL SERVICE PLANNING AND NEEDS ASSESSMENT:

Needs Assessment

The needs assessment is completed within 30 days and addresses the participant’s:

Psychosocial status (awareness level, personal care needs, need for privacy or socialization);

Functional status (endurance and capability for ambulation, transfer, and managing activities of daily living); and Physical status, to be determined by observation, from the intake screening interview, and from the medical report received from the participant’s physician.

 

PRELIMINARY SERVICE PLAN:

Preliminary Service Plan

Within 30 days of admission, Cross Cultural Care Center develops a preliminary service plan based on the assessment in 9555.9700, subpart 2, item A, and coordinated with other plans of services for the participant.  The preliminary service plan includes:

(1) the scheduled days of participant’s attendance at the center;

(2) transportation arrangements for getting the participant to and from the center;

(3) the participant’s nutritional needs, and dietary restrictions, where applicable;

(4) the role of the participant’s caregiver(s) in carrying out the service plan; and

(5) services and activities in which the participant will take part immediately upon admission.

 

INDIVIDUAL PLAN OF CARE

Within 90 days of the participant’s admission to the center, a written and dated plan of care is developed by the center staff together with the participant, caregiver, and other agencies and individual service providers. The plan of care includes:

  1. an update of the preliminary service plan required in subpart 2 and additional services required by the participant;
  2. short and long-term objectives for the participant stated in concrete, measurable and time specific outcomes;
  3. the staff members responsible for implementing the individual plan of care;
  4. the anticipated duration of the individual plan of care as written, and
  5. provisions for quarterly review and quarterly revision of the individual plan of care.
